Please be aware a public body may enter executive session under Purpose 2 to “conduct collective bargaining sessions” and under Purpose 3 to “discuss strategy with respect to collective bargaining or litigation if an open meeting may have a detrimental effect on the bargaining or litigating position of the public body and the chair so declares.” G.L. c. 30A, §§ 21(a)(2), (3). These purposes allow a public body to discuss collective bargaining strategy and bargain directly with a union in executive sessions. Due to the purposes stated above, the Negotiation Committee may choose not to publish minutes to their meetings, but all contracts that are derived from their deliberation will be public upon execution.
